Terms of Service

1. Purpose

These Terms of Service govern access to and use of the Bref Point mobile app and website ('the Service'), published by Bref Point ('we'). By creating an account or using the Service, you unreservedly accept these Terms.

2. Service Description

Bref Point is a sales management and invoicing application for African merchants. It enables creating and sending invoices, managing shops and teams, tracking payments, and analyzing business performance via the integrated analytics assistant.

3. Access to the Service

Access is reserved for adults (18 years and over) or legal representatives of legal entities. To use the Service, you must:

• Create an account with accurate, up-to-date information.
• Have a compatible device (iOS or Android) and an internet connection.
• Maintain the confidentiality of your login credentials.

4. User Account

You are responsible for all activities carried out from your account. Bref Point shall not be liable for damages resulting from unauthorized use of your account if you failed to comply with your security obligations.

5. Acceptable Use

It is prohibited to use the Service for:

• Any illegal, fraudulent, or public-order-violating activity.
• Creating fictitious or misleading invoices.
• Compromising the security, integrity, or availability of the Service.
• Reselling or commercially exploiting the Service without written authorization.
• Importing or transmitting malicious content (viruses, malware, etc.).

6. Responsibility for Data Entered

You are solely responsible for the accuracy, legality, and completeness of all data you enter into the Service (invoices, customer information, prices, accounting data). Bref Point does not verify the accuracy of your data and shall not be liable for errors, omissions, or inaccuracies in your records. You warrant that the data you enter does not infringe any third-party rights.

7. AI Analytics Assistant Disclaimer

The analytics assistant integrated into Bref Point provides suggestions for informational purposes only. Results are generated automatically and may contain errors or inaccuracies. Bref Point does not guarantee their accuracy, completeness, or suitability for specific business decisions. The assistant does not constitute financial, tax, accounting, or legal advice. You remain solely responsible for your business decisions.

8. Subscriptions and Payments

Paid subscriptions are automatically renewed at the end of each billing period unless cancelled beforehand. No pro-rata refund is granted for early cancellation during a billing period. You may cancel your subscription at any time from the app settings, and the cancellation will take effect at the end of the current period.

9. Intellectual Property

All elements of the Service (interface, code, trademarks, logos, texts) are the exclusive property of Bref Point and protected by intellectual property laws. Unauthorized reproduction is prohibited.

10. User Data

You retain ownership of data entered into the Service. You grant Bref Point a limited, non-exclusive, revocable license to operate the Service, as described in our Privacy Policy.

11. Service Availability and Data Backup

We strive to ensure the Service is available 24/7. We reserve the right to interrupt the Service for maintenance or in cases of force majeure, without notice or compensation. While Bref Point implements backup procedures, we do not guarantee full data recovery in the event of loss. We recommend regularly exporting your data using the export features available in the app.

12. Service Provided 'As Is'

The Service is provided 'as is' and 'as available', without any express or implied warranty of commercial results, business growth, or fitness for a particular purpose. Bref Point does not warrant that the Service will be uninterrupted, error-free, or that results obtained will be accurate or reliable.

13. Limitation of Liability

To the extent permitted by law, Bref Point shall not be liable for indirect or consequential damages arising from use of the Service, including: data loss, loss of revenue or profits, or business interruption. Total liability shall not exceed amounts paid in the last 12 months.

14. Indemnification

You agree to indemnify, defend, and hold harmless Bref Point, its officers, employees, and agents from and against any claims, damages, obligations, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Service in violation of these Terms; (b) data you enter, transmit, or share through the Service; (c) any infringement of third-party rights caused by your use.

15. Termination

You may delete your account at any time from the app settings. Bref Point reserves the right to suspend or terminate your access in case of violation of these Terms, without notice or refund.

16. Changes to Terms

Bref Point may modify these Terms at any time. In case of substantial changes, you will be notified by email or in the app. Continued use of the Service constitutes acceptance of the new Terms.

17. Governing Law

These Terms are governed by the applicable law in the country where Bref Point is registered. In case of dispute, the parties agree to seek an amicable solution first. Otherwise, competent courts at Bref Point's registered office shall have jurisdiction.
